Punta Gorda is the only incorporated city in Charlotte County and the county seat, on the south bank of the tidal Peace River where it opens into Charlotte Harbor. Plenty of land with a Punta Gorda address is not in the city, though. It sits in unincorporated Charlotte County, and the two governments regulate trees and clearing differently. We verify the parcel first, and we suggest you confirm it with the city or the county before you hire anyone.

Inside the city, Punta Gorda's code says no one may cut down, remove or destroy a native or approved non-native tree 12 inches or larger in diameter at breast height without an approved tree removal permit. Outside the city, Charlotte County's threshold is much lower: a tree permit for any tree 4 inches in diameter or more, and a permit for clearing with machinery bigger than a standard lawn mower.

Chop has 15+ years on heavy equipment and does the work himself. We do full clearing for homesites and forestry mulching for acreage, fence lines and overgrown back lots. For the rest of what we do in town, see our Punta Gorda page.

Inside city limits: Punta Gorda's tree removal permit

The city's rule turns on 12 inches at breast height, measured about 4.5 feet up the trunk. Native and approved non-native trees at or above that size need the permit. If removal leaves the property below the city's minimum landscape requirements, the city code requires replacement trees. The city also describes a no-charge tree removal permit that may be approved under certain conditions, so ask before you assume a fee.

The city's tree page deals with individual trees, so before machine work inside Punta Gorda we have the owner confirm with the City of Punta Gorda what it wants for clearing that lot. One call up front beats a stop-work order.

Outside the city: Charlotte County rules

Unincorporated Charlotte County requires a tree permit for trees 4 inches and up and a permit for machine clearing. Property over 1 acre that is being developed needs a protected species assessment and a FLUCCS map. Scrub-jay nesting season runs March 1 to June 30, and scrub-jay parcels get a separate review with no clearing during nesting season. A bald eagle nest within 660 feet requires a management plan. Charlotte County Community Development can confirm what applies to your parcel.

Gopher tortoises fall under state rules on both sides of the city line: stay 25 feet from every burrow or get an FWC permit before work. Our guide to burrows before clearing covers how that works.

Low ground, the waterfront and storm leftovers

Punta Gorda sits low, around 7 feet above sea level, between the river and the harbor. Parcels near the water can have wetland edges or mangroves, and those fall under state and federal rules on top of the local tree permit. If your land touches the water or holds water in the rainy season, sort that out before any clearing.

The city took a direct hit from Hurricane Charley, a Category 4, on August 13, 2004. If your lot has storm-broken trees or old debris piles, we clear those with the rest of the job, and our storm cleanup page covers bigger messes.

Questions about land clearing in Punta Gorda

Not covered here? Call Chop at (239) 560-2996.

Do I need a permit to remove trees in Punta Gorda?

Inside the city, yes, for native and approved non-native trees 12 inches or larger at breast height; the City of Punta Gorda requires an approved tree removal permit. Outside city limits in Charlotte County, the threshold is 4 inches, and clearing with machinery also needs a permit.

How do I know if my Punta Gorda property is inside city limits?

Call the City of Punta Gorda or Charlotte County with your parcel number. A Punta Gorda mailing address does not mean the city regulates the land, and the tree and clearing rules differ on each side of the line.

Is forestry mulching or full clearing better for Punta Gorda acreage?

Mulching suits land you are not building on yet: underbrush and small trees ground in place, roots left to hold the soil. Full clearing is for the house pad, driveway and septic, where roots and chips cannot stay. Either way, trees over the city or county size threshold need the permit first.

Does scrub-jay season apply to land around Punta Gorda?

Outside city limits, Charlotte County's guide sets scrub-jay nesting season at March 1 to June 30, with no clearing on scrub-jay parcels during that time. Inside the city, ask the City of Punta Gorda. The Florida scrub-jay is federally listed, so federal rules apply wherever the birds are.
